Hello to everyone on the list,

(I don't post often here, and I hope this won't be considered off-topic.)


We managed last September to get a vey important amendment voted in the
European Parliament, on the first reading of the "Telecoms Package"
regulating Internet. You may have heard heard of am.138, which restates,
that a restriction of fundamental rights and freedom can only be imposed
by the judicial authority.

This comes right in a text being hijacked to legalize a pan-european
"graduated response", according to Sarkozy's friends will. In this
scheme, citizens alleged of file sharing are disconnected from the
internet, with impossibility to subscribe a new access, by an
administrative authority accessing their personnal data, without a due
process.

In the meantime, the "graduated response" has just been voted in
France, and it's the worst obscurantist decline of fundamental rights
we've seen regarding internet regulation for a very long time. It is a
perfect example of what their plan is for Europe (and beyond).

It came to our knowledge that the Council of EU is now about to remove
that amendmeent voted by 88% of the representatives of the European
People, opaquely, and without a debate. (The same might happen to am.166
recalling the principle of proportionnality, and the crucial framing
added to am. 181 recalling the due respect to privacy when processing
connection data for "security" purpose!)



It is time for European citizens and especially NGOs to write an open
letter to their representatives in the Council in order to urge them not
to sell the whole EU structure to the private interests of Mr Sarkozy.

I think there are among the readers of this list many European
individuals, academics, and NGO leaders who could participate to such an
operation, and write such a letter.

Time is short, as the Council's decision will happen on Nov.27th.
