The French bill implementing the "Olivennes" proposals has been brought bef=
ore the French Council of State (although some rumors say that the Council =
will not take a position before the summer...).
The latest version of the bill is more flexible.
Namely, the High Authority (HADOPI: "Haute Autorit=E9 pour la diffusion des=
oeuvres et la protection des droits sur Internet") should have the possibi=
lity (and not the obligation as provided in the previous versions of the bi=
ll) to (see Article 16 of the bill):
1=B0) send a warning message to the alleged infringing user;
2=B0) In case of "repeated" infringing acts, estimated within a period of o=
ne year (without any further precision), ask for the termination of Interne=
t access for a one year period with the impossibility for the user to subsc=
ribe to another Internet provider.
However, instead of this sanction procedure, the Authority can propose a "t=
ransaction" consisting in suspending the Internet access service for a shor=
ter period of time, from 1 to 6 months. If the user rejects this transactio=
n, the Authority can then pronounce the termination for one year.
Other flexibility introduced in the bill: Internet access providers should =
not have the obligation to provide their users with "efficient" systems pre=
venting the use of the networks for infringing purposes by third parties, b=
ut should only have the obligation to inform them about the existence of su=
ch systems.
A Decree would precise the implementation of these provisions.
