The making available right has its origin at the WCT and WPPT treaties and =
it was agreed as the "umbrella solution" because the activitie might be cov=
er in national law by the comunication to the public right or the reproduct=
ion and or distribution or others. So certainly in a WCT country the  makin=
g available activity might be under a different right than distribution.

RIAA summary judgment motion denied in Atlantic v. Howell; RIAA 'making ava=
ilable' theory & Judge Karas 'offer to distribute' theory rejected: making =
a music file available in a Kazaa shared folder is not an unlawful distribu=
tion of a copyrighted work. To infringe the right of distribution under cop=
yright law, the owner must prove the "actual dissemination of copies or pho=
norecords," the court held.

In other words, copyright owners must prove that the file was actually down=
loaded by someone.

RIAA qualifies this decision (only a District Court decision) as "strange".=
