FYI: UNCITRAL Guide and Intellectual property

UNCITRAL Working Group VI Security interests (next meeting: 13 th
session, 19-23 May 2008, New York).  Yes, the working group on
Security interests.


The United Nations Commission on International Trade Law (UNCITRAL)
has drafted and will publish a legislative guide for developing
countries regarding secured financing transactions. The Guide was
adopted by UNCITRAL in December 2007.  The guide was apparently not
drafted with IP in mind ...and now a number of "IP experts" (industry
associations etc) are getting involved. There are choice of law issues
and also questions re the guide and TRIPS.

In June-July 2007, UNCITRAL approved additional work, for an annex to
the Guide, annex that should provide "specific guidance to states as
to the appropriate coordination between secured transactions and
intellectual property law".
