Jamie, I strongly recommend taking a look at the article on "A Reverse
Notice and Takedown Regime to Enable Public Interest Uses of Technically
Protected Copyright Works" by Reichman, Dinwoodie & Samuelson in the
Berkeley Tech Law J, vol. 22, no. 3 (2007). Available at SSRN. It makes
a very cogent proposal for implementation in both US and EU copyright
law, and should be raised at WIPO as well.
