The French Committe on copyright ("CSPLA": "Conseil Sup=E9rieur de la Propr=
i=E9t=E9 Litt=E9raire et Artistique") has just released its Report on Orpha=
n works :

In a nutshell, the Committee recommends that:
- Orphan works should be expressly targeted by the French copyright law in =
a new category of works;
- For written works and graphic images, a system of mandatory collective ma=
nagement should be put in place. Existing collecting societies should recei=
ve a mandate from the Ministry of culture and should participate to a commo=
n digital portal aimed at facilitating access and update of documentary res=
ources on orphan works;
- For musical and audiovisual works, changes to the current system have bee=
n deemed not necessary;
- The criteria for the legal definition of orphan works should be determine=
d by representatives of rightholders, of users and of the administration wi=
thin an ad hoc commission;
- A politic of prevention of orphan works should be encouraged (through the=
amelioration of the systems of identification of rightholders).
