At the World Intellectual Property Organization (WIPO) General Assembly in question, the Commission took note of the proposal for a "Development Agenda" for WIPO submitted by Brazil and Argentina.
During that Assembly, the European Community and its Member States indicated that the protection of intellectual property rights should not be viewed as an end in itself, but as a means of contributing to the progress and welfare of individuals and societies throughout the world. The efficient and equitable transfer of technology linked to intellectual property lies at the heart of the global economic development and a WIPO organization that successfully upholds intellectual property rights in a balanced manner is in the interest of all.
The Commission therefore believes that WIPO should continue its development related activities and in this context the proposal of Argentina and Brazil is useful progress in strengthening the development dimension of WIPO´s work. However, this can only be achieved if the fundamentals, including rights and obligations, of the international intellectual property system are properly understood and accepted.
The Commission takes an active part in the debate on the WIPO Development Agenda. It will participate constructively in ongoing work in Committees such as the Intergovernmental Committee for Genetic Resources, Traditional Knowledge and Folklore which is in particular oriented towards the interests of the people in developing countries.
Parliament will be involved in accordance with its prerogatives under the EC Treaty and the Framework Agreement between the Commission and Parliament which foresees that Parliament is kept informed about the negotiations.The Commission wishes to stress that in most areas discussed in WIPO the competence of the Community is shared with the Member States.
