The problem is with Microsoft management not the
technology.
That is why the remedy must remove power from corrupt
management.
Otherwise, you will be required to implement an enormous amount
of
regulations and rules. And, the court is ill-suited to do
that.

This is the most cogent statement I have read from
this hand. I find it hard to disagree.
But I do feel that the power you speak of is based
not on some excess larceny in the heart of management but in the licenses
they are granted to use it by not having to disclose one jot of code, along with
the rest of the world. I do not see them being unique in this regard other than
having overachieved at it.
You do not have to ask the Court to set the
guidelines and maintain a vigil. The Court's findings are sufficient to
warrant a legislative assessment of the granting process. Case
closed.
I apologize in advance for the simplicity of this
notion.
