Database Legislation & UCC

I'm in the midst of writing a research paper on the recent database
legislation and pending UCC revision (Article 2b), and I was wondering
if anyone could help me out with a few questions I have:
First off, is any further legislation in the pipeline (i.e., after H.R.
3531, 2652 and 3048)?
Is anyone else worried that ProCD v. Zeidenberg, by finding
non-negotiable licenses enforceable, might effectively cut off access to
factual information otherwise in the public domain? And does the
revision to Article 2b set this in stone?
Which is better off for the public interest in unfettered access to
facts and ideas -- the database sui generis property right in H.R. 3531?
or the misappropriation doctrine in H.R. 2652?
Any responses would be greatly appreciated. Thanks in advance.
