To borrow one of your favorite phrases, "You're being obtuse."  The DOJ,
the states, and Caldera have charged Microsoft with violating the law (the
Sherman Act).  Most people would consider charging Microsoft with breaking
the law to be equivalent to charging Microsoft with a crime, regardless of
the actual legal definitions.
