Siblings as next of kin

I've heard two versions of priority:

1) when offspring of deceased are next of kin, all siblings stand equally
	as next of kin

2) when offspring of deceased are next of kin, older/oldest sibling IS next of
	kin


I am unaware of any modern statute or case law supporting #2.

Anyone else have any opinions.
