I was excited to see an interesting discussion/debate on the list - isn't 
that what its for at least one of the purposes.

Anyway a few additional thoughts on the discussion.  The Alcohol and Drug 
regs allow a facility to disclose records generated from another site if 
the patient specifically authorizes the re-release of these second 
generation records.  I know these regs do not apply to most facilities 
but they go out of their way to protect patient privacy so perhaps we can 
look to them for some guidance.

Another thought, the issue of whether the record belongs to the provider 
to who it was released to the original provider depends on if the second 
provider used the information to base his care on.  If the provider did 
so, it
becomes part of that providers record and can be released.  For example, 
the hospital records used by the nursing home to take the place of the 
NH's H & P.  No one questions that those records are part of the nursing 
home record.  Or do they???
