who pre-empts whom



My last message on the pre-emption thing wasn't written to well.  S. 1360 
pre-empts most state laws on medical records privacy, except for the 
areas which are spelled out in Sec. 401.  The areas not pre-empted by the 
feds are:

-   state law on the privileges of witnesses, vital statistics, 
    records on abuse or neglect of an individual, public or mental
    health records, rights of minors to medical records,


-   Federal or states law which establishes a privilege for records
    used in peer review activities.
