With the consent of the record subject.  Same way they get it today.  
Someone else posted a comment to the effect that you don't have a choice 
if you want insurance.  I don't take issue with that.  For what it is 
worth, the health privacy legislation is not regulating the life 
insurance industry.  That is (or perhaps should be) the subject of another 
bill.  Virtually all life insurance regulation takes place at the state 
level.
