Re: consent under s. 1360
A week ago I asked Janlori if she could clarify some issues regarding the
consent provisions of S. 1360, and since she didn't respond, perhaps Bob
Gellman or someone else can help out. It is my understanding that
insurance companies and others are pretty much free to ask for consent
before selling insurance, but that employers have some limits, under the
Americans for Disabilities Act of 1990, before a job is offered.
However, after a job is offered, employers can apparently require exams,
or review medical records, if they are self insured.
Once someone is offered a job, what types of requests for "consent" for
access to medical records can be "requested" by employers? jamie
